General Terms and Conditions
1. Introduction:
Welcome to Capila, a platform designed to support individuals through their hair transplant recovery journey. These Terms and Conditions govern your use of Capila’s services, which include a mobile app for patients and a web app for clinics. By accessing or using the application, you agree to comply with and be bound by these terms. Please review them carefully before using the services.
2. Acceptance of Terms:
By using the Capila mobile or web application, you signify your agreement to these Terms and Conditions. If you do not agree to these terms, please discontinue use of the application immediately.
3. Privacy Policy:
We respect your privacy and are committed to protecting your personal information. Please refer to our Privacy Policy for details on how we collect, use, and protect your personal data, applicable to both the mobile and web apps.
4. Intellectual Property:
All content, design, graphics, organization, and other elements of Capila’s applications are protected by copyright, trademark, and other proprietary rights. Unauthorized use, copying, redistribution, or modification of the content is strictly prohibited.
5. Disclaimer:
The Capila platform (both mobile and web apps) is provided on an “as-is” basis. We make no warranties, express or implied, regarding the accuracy, reliability, or completeness of the information provided.
6. Limitation of Liability:
Capila, its affiliates, or their respective directors, employees, or agents will not be liable for any direct, indirect, incidental, special, or consequential damages arising from your use of the application, including loss of data or business interruption.
7. Changes to Terms:
Capila reserves the right, at its sole discretion, to modify or replace these Terms and Conditions at any time. If a revision is material, we will notify users at least 30 days before any new terms take effect. Continued use of the services after any changes constitutes your acceptance of the new terms.

Terms for Mobile App Users (Patients)
1. AI Chat Support:
The mobile app provides AI-powered chat support to assist users during their recovery journey. While we aim to provide helpful and accurate information, users should consult with healthcare professionals for serious medical concerns. Capila is not liable for misinterpretations arising from the use of the AI chatbot.
2. AI Chatbot Usage Duration:
Users will have access to the AI chatbot for one year from the date of activation. After this period, Capila may limit or discontinue access to the chatbot. Any changes to this service will be communicated in advance.
3. Data Collection and Usage (Mobile App):
Capila collects and analyzes user data (including chatbot interactions) to improve app functionality. User data is processed internally and is not shared with third parties unless permitted by the user.
4. Anonymized Data and Insights:
We may use anonymized and aggregated data from the mobile app for research and development purposes. This data will not contain personally identifiable information.
5. User Consent to Data Usage:
By using the mobile app, users consent to the collection and analysis of their data, as outlined in these Terms and our Privacy Policy.
6. Opt-Out Provision:
Mobile app users can opt-out of data collection and analysis at any time. However, opting out may limit some of the app’s functionality.
7. Termination (Mobile App):
Capila reserves the right to terminate or suspend a user’s access to the mobile app for violating these Terms or for conduct harmful to other users or the company.
Terms for Web App Users (Clinics and Pros)
1. Subscription and Payment:
Clinics using Capila’s web app must pay per patient they invite to use the mobile app. Each patient receives access to Capila for one year. Clinics may continue to access historical data even if their subscription ends, but they will not be able to invite new patients.
In the future, we may introduce subscription plans allowing clinics to invite a set number of patients per month, which will be detailed in this section when available. Clinics will receive clear billing information and be able to manage subscriptions directly in the app.
2. Payment Failure:
If a clinic’s payment method fails (e.g., expired credit card), we will notify them via email and a banner in the web app. If unresolved within 7 days, the clinic’s ability to invite new patients will be suspended. However, existing patients will continue to access the mobile app. Once payment is updated, all features will resume.
3. Data Collection and Usage (Web App):
Clinics can access patient data such as names, emails, and onboarding questions, but they will not have access to private patient data, such as their interaction with the AI chatbot. Capila generates anonymized reports for clinics based on trends across multiple patients. These reports will be shared periodically to help clinics understand general trends and outcomes.
4. Data Security (Web App):
Capila employs security measures to protect clinic and patient data from unauthorized access or disclosure. However, Capila cannot guarantee absolute security, and clinics should take their own measures to safeguard patient information.
5. Termination (Web App):
If a clinic terminates their subscription, existing patients will continue to have access to the mobile app. However, the clinic will lose the ability to invite new patients until they reactivate their subscription.
6. Marketing Emails/Notifications:
Clinics will receive important notifications and updates regarding their subscriptions and patients. Clinics may also opt-in to receive marketing emails or product updates. Marketing communications can be managed through the settings page in the web app.
